The terms that govern use of Shopiwebs Book, both for businesses that run a booking page on it and for the people who book through one.

The agreement

These terms form an agreement between Shopiwebs Import Ltd, a company incorporated under the laws of the Republic of Mauritius ("Shopiwebs Book", "we") and the person or business creating an account or requesting a trial ("you").

They apply as soon as you request a trial, create an account, or use the platform. The Privacy Policy and the SMS Terms form part of this agreement and are incorporated by reference.

The version and effective date appear at the top of the page.

Your account

You must provide accurate information and keep it current. You must be at least 18 to open a business account.

Sign-in works by a link sent to your email: there are no passwords. Your mailbox is therefore the key to your account — you are responsible for protecting access to it and for telling us promptly at info@shopiwebs.com about any unauthorized access.

A business account corresponds to one business. Multiple staff members may be attached to the same business.

Bookings and clients

Each business alone decides its services, prices, staff, hours and cancellation policies. A booking creates a relationship between the client and the business — not with us. We provide the software that makes it possible.

Any problem with an appointment (lateness, cancellation, quality of service, refund of a service) must first be raised with the business concerned. Its contact details appear on its booking page and in confirmation emails.

Payments and payouts

Payments are processed by Stripe and deposited directly into the business's own Stripe account. We never hold businesses' revenue and are not a party to any payment between a client and a business.

Each business is responsible for its Stripe fees, its refunds, and its tax obligations (including applicable sales taxes).

"Deposit" mode: the client's card is pre-authorized, not charged. It is charged only if the business confirms a no-show, per the policy displayed before the booking is confirmed. Refunds, where applicable, are processed by Stripe and follow Stripe's refund timelines.

Fees, trial and cancellation

The platform is currently free during early access. Subscription fees may be introduced later, with at least 30 days' notice (see section 12).

The trial lasts 7 days (unless we grant an extension). During the trial, SMS and email notifications on the booking page are switched off — you expressly acknowledge this when requesting the trial.

You may close your account at any time. Cancellation windows for clients' appointments are set by each business and displayed before confirmation.

Acceptable use

You must use the platform lawfully and without harming others: no fraud, spam, impersonation, abusive automated collection, or interference with the security or operation of the service.

If you breach these rules, we warn you first and give you a chance to correct — except for fraud or security risk, where we may suspend immediately.

Your content and data

Content you publish (service names, descriptions, photos, logo) remains yours. You grant us a limited licence to host and display it, solely to operate the platform.

For your clients' personal information, you are the party responsible for it and we act as a service provider on your behalf, consistent with applicable privacy laws. Our Privacy Policy describes our practices; you remain responsible for obtaining the required consents from your clients.

Availability and support

The service is provided "as is" and "as available". We do not guarantee uninterrupted operation and may perform maintenance, aiming to limit interruptions.

Liability

To the extent permitted by law: we are not liable for indirect losses (lost profits, goodwill or data); our total liability is capped at the greater of the fees you paid us in the 12 months preceding the claim, or CA$100.

Nothing limits liability that cannot be limited by law (intentional or gross fault, bodily injury).

Consumer rights

If you are a consumer within the meaning of applicable consumer-protection laws, nothing in these terms limits rights you cannot waive. Any incompatible clause applies only to the extent the law allows.

Ending the agreement

You may close your account at any time. We may terminate for breach (with the notice in section 6) or discontinue the service with reasonable notice.

If your account closes, you remain responsible to your clients for already-confirmed appointments (honour them or cancel with notice to the client).

After closure, your data remains restorable for 30 days, then is deleted per the Privacy Policy.

Changes to these terms

We may change these terms. For any material change, we will notify you by email at least 30 days before it takes effect. Continued use after that date constitutes acceptance; otherwise you may close your account before the effective date.

Governing law and jurisdiction

This agreement is governed by and interpreted in accordance with the laws of the Republic of Mauritius, without regard to conflict-of-laws rules.

Subject to section 10, any dispute arising out of or relating to this agreement is subject to the exclusive jurisdiction of the courts of Mauritius.

Nothing in this section deprives a consumer of mandatory rights conferred by the public-order laws of their place of residence, including, where applicable, the right to bring proceedings before the courts of that place.
